A survivor of the Nottinghamattacks that resulted in three deaths stated that the victims should have been part of a care assessment processNHSbelieve that he took care of his attacker.
A schizophrenic individual named Valdo Calocane murdered Barnaby Webber and Grace O’Malley-Kumar, who were both 19 years old, as well as caretaker Ian Coates, aged 65, andattempted to take the lives of three additional individuals in Nottingham during June 2023.
A critical report from the Care Quality Commission (CQC) regarding the Nottinghamshire Healthcare NHS Foundation Trust, which provided care to Calocane between May 2020 and September 2022, revealed that the environment “was not consistently humane, respectful, or delivered high-quality treatment” to patients.
Survivor Wayne Birkett and his attorney Greg Almond, who also advocates for attack survivor Sharon Miller, stated that the victims were not part of the CQC inspection and only learned about it via the media a day prior to its release.
Mr. Birkett, who has endured suffering since being struck by a van during the incidents, stated: “I don’t understand why I wasn’t included or informed about this earlier.”
That’s all I have to say on the matter, truly, since we should have been informed, we should have been alerted.
Regarding the attacker, Mr Birkett stated, “These individuals should not be allowed to roam free, and the NHS needs to enhance its performance.”
He mentioned it was “quite embarrassing” to be unaware that the inspection was happening.


The CQC conducted 39 inspections at the trust from May 2024 to August 2025, prior to a leadership assessment in September of last year.
The report, released in early January, stated that the trust violated management guidelines and was required to submit an action plan. Seven out of the trust’s 18 services were rated as needing improvement, including five mental health services.
Lawyer Mr. Almond stated: “It’s surprising that we weren’t informed about the report in advance.”
It is evident that this had a significant impact on my clients, and they should have been informed about it. They should have been alerted that this was going to be released.
And we shouldn’t have learned about it through the media.
Mr. Birkett was struck by a van that the perpetrator had stolen from caretaker Mr. Coates following his murder, and has since experienced ongoing pain, headaches, and fatigue, which he referred to as ‘a nightmare’.
The survivor and his legal representative are urging that victims be incorporated and their perspectives acknowledged in the public investigation of the attacks, ahead of their meeting with Health Secretary Wes Streeting on February 5.
Mr. Birkett stated, “I hope the man (Wes Streeting) can assist. I hope so.”


Mr. Almond, his attorney, stated: “I anticipate him paying attention to our worries. I expect him to outline a strategy regarding what the government plans to accomplish. It is evidently a matter of high importance.”
We are aware that he has numerous responsibilities, and it’s clear he is extremely occupied, but this matter is essential to his position and the reason he was appointed, which is to safeguard the public and ensure the NHS remains a top priority.
So, this is what we aim to convey to him. It’s not like this hasn’t been brought to attention previously; this additional report simply reinforces that.
And we certainly don’t wish to experience another disaster on the streets of Nottingham or in any other part of the country.
The investigation into the attacks is set to begin on February 23 and will last for two years, led by former senior judge Deborah Taylor.
Mr. Almond stated, “We have a genuine hope that the investigation will provide the responses we require.”
We certainly have a seasoned legal team, just like the families do, and we, together with them, will spare no effort to uncover the truth behind these matters.
Considering the CQC report’s conclusions, Mr Almond stated: ‘Our response was one of disbelief, but I wasn’t truly surprised, given that the trust has been underperforming for a long time, and this recent report only highlighted that.’
He stated: “I believe a full transformation is required, a structural shift in leadership, and it must occur swiftly.”
The moment has arrived for the government to intervene and implement genuine measures.
And whether it involves additional resources, or a suitable government intervention, it must take place.
The residents of Nottingham must understand that their NHS is secure and that they can carry out their everyday activities in Nottingham without any concern about similar incidents occurring again.
The interim director of mental health at the Care Quality Commission, Jenny Wilkes, stated: ‘We remain committed to expressing our deepest condolences to all those impacted by the tragic incident that occurred in Nottingham in June 2023.’
The document released on January 14 details our results from a comprehensive well-led review conducted across the trust in September 2025, aimed at evaluating the leadership at Nottinghamshire Healthcare NHS Trust.
This comes after a series of evaluations suggested by our review of the trust, released in 2024.
