In January, singling out left-leaningprograms such as Saturday Night Live, The View, Jimmy Kimmel, and Stephen Colbert, Trump’s FCC Chairman Brendan Carr brought back a previously inactive “equal time” policy to issue new regulatory guidancedemanding that these programs provide “equal time” to political candidates during an election season. The regulation was first implemented in 1934, but theshowsCarr is now focusing on those who had been exempted under a “news” provisionsince 1959.

Although Carr stated that the new rules apply to programs “driven by partisan goals,” he is not enforcing them against Fox News, a mixed-format channel.news and entertainment networkthat operates 24/7 with Trump’s messaging. Nor is he using them against ultra-partisan conservative radio, whichthe FCC also regulates). Rather, Carr is concentrating on what he refers to as “left-leaning” entertainment content.

Application of federal communication rules in a selective manner according to political preferences is evidentviolates the First Amendment. Although networks might take legal action against the FCC based on the First Amendment and allegations of improper use of administrative power, it remains uncertain whether the Roberts court would issue a ruling in time to have any impact.

FCC targets Talarico

On Monday, following either the FCC or corporate-owned CBS warning of legal consequences if Stephen Colbert broadcast aninterview with James Talarico, a Texas Democrat running for U.S. Senate, the recorded interview was taken off the program. Whether CBS was instructed to remove the interview orbent the kneehas been a topic of discussion, but it is evident that the Trump administration became worried about Talarico specifically after heappeared on The View in early February.

Talarico, a legislator from Texas, isa deeply religious Democraticlawmaker causing controversy with MAGA’s religious double standards. He appears like a Southern Baptist minister buthe resembles a genuine person of belief. Challenging Trump’s far-right supporters, Talarico criticizes the disgraceful gap between Christ’s teachings and the harm Trump is causing across the nation andaround the world.

A Presbyterian seminarian, Talarico has received national recognition for employing his theological training to critique Christian nationalism, denouncing it as atreachery against Jesus of Nazareth,that “worships power under the guise of Christ.”

Talarico: It’s time to begin overturning the tables

Talarico uses the teachings of Christ to oppose corporate influences.

He perceives the right versus left political split in the U.S. as intentionally created, whereas the real division lies between the wealthy elite and the lower classes.sayingRich individuals want us to focus on fighting among ourselves rather than noticing them stealing from us.” The Trump-led elite creates divisions “so we don’t see them reducing funding for our schools, undermining our healthcare system, and lowering taxes for themselves and their wealthy associates. It’s a classic tactic: divide and rule.

Trump’s FCC ridicules Equal Time

The equal opportunity section (315) of theCommunications Act of 1934was a positive concept. It was implemented to enhance First Amendment rights by mandating that all broadcast license holders provide equal exposure to every legally eligible candidate running for political positions.

It adhered to the Fairness Doctrine, which mandated that when a political viewpoint was broadcast, both perspectives be presented. The Fairness doctrine wasrepealed during Ronald Reagan’s tenure in 1987, and our nation has become more polarized since then.

The irony of seeing Carr bring back the concept of “fairness” is that Republicans have historically rejected fairness in the media; the Heritage Foundation criticized the Fairness Doctrine.in 1993), claiming that mandating both sides of a political debate infringed on free speech. Observing Carr now enforcing “equal time” for left-leaning radio programs while disregarding right-wing perspectives undermines the fairness standards that originally inspired the law.
