A man in his 30s received a prison sentence after fatally assaulting his 42-day-old son, stating the baby’s crying as the justification.

The 11th Criminal Division of the Daegu District Court (led by Presiding Judge Lee Young-cheol) on the 25th handed down a 13-year prison sentence to A (34) for offenses including murder through child abuse. Furthermore, the court required A to attend an 80-hour program focused on addressing child abuse and imposed a 10-year ban from working at relevant institutions.

Person A is charged with violently hitting the head and other parts of his son B’s body at their home in Dalseong-gun, Daegu, in September of last year, resulting in B’s death, and then burying the body on a nearby hillside.

At the trial, A stated, “I did not plan to kill my son.” Nevertheless, the court decided, “It is reasonable to expect that someone weighing more than 100 kg could result in the death of a 42-day-old baby weighing just 4 kg through forceful strikes,” recognizing indirect intent in the murder.

The court also observed that A did not promptly contact 119 or take urgent actions following the attack, and instead buried the child on a hillside the next day, suggesting an absence of regret or sorrow for the child’s death.

The court remarked, “Even though A surrendered after the offense, his behavior seemed more directed towards ensuring his own security from possible arrest rather than true remorse,” and noted, “The punishment was decided by taking into account A’s responsibility to care for his two daughters following this incident.”
