According to the order, Trump would assert that China influenced the 2020 presidential election, which could serve as a basis for Trump to control how states manage their elections during the midterms—likely enforcing certain elements of the GOP-supported SAVE America Act through executive action, which introduces new voting restrictions and identification rules.

The report caused an instant response from officials on social media, with numerous individuals stating that this plan is inherently unlawful — and would face rejection in court if Trump attempted it.

There is no national emergency exception under Article 1, Section 4 of the Constitution,wroteRep. Ted Lieu (D-CA) stated, “States oversee elections unless Congress enacts legislation. That is why Trump is urgently seeking to pass the Save Act in an attempt to limit voting rights. The courts will once again reject Trump’s efforts, similar to how they handled his unlawful tariffs.”
“Yet more nonsense,” wrotecolumnist James Surowiecki stated, “Declaring a national emergency does not enable the president to seize control of elections, which the Constitution assigns to the states and Congress.
